  1. General Part

1.1. Tadah

Tadah AG (hereinafter "Tadah") is a company specialising in the provision of flexible workplaces (co-working space) with childcare or in-house childcare facilities. In the course of this, Tadah offers services in the area of event organization and rentals. For companies, Tadah offers additional services in the area of consulting, guidance and coaching in the area of compatibility as well as marketing and communication services. Tadah also runs a digital magazine and an online shop for parents.

1.2 Swiss Re Kids House

The Swiss Re Kids House is a flexible on-demand childcare facility at Swiss Re's headquarters at Campus Mythenquai (specifically Lavaterstrasse 93, 8022 Zurich). The Swiss Re Kids House is a childcare facility for children aged three months to 12 years. The maximum number of children that can be cared for in Swiss Re Kids House depends on the age composition of the children's groups. The Swiss Re Kids House exclusively looks after children of Swiss Re employees.

1.3. Scope

These general terms and conditions ("GTCs") form an integral part of the childcare contract between the parents or legal guardians (hereinafter "Customer") and Tadah in relation to the child's place and childcare at Swiss Re Kids House.

The entire childcare contract between Tadah and Customer consists of:

  • these GTCs
  • the operating concept
  • the pedagogical concept
  • the privacy policy

The operating concept, pedagogical concept and privacy policy are available to Customer on the Booking System (as defined below) as well as the Swiss Re Kids House SharePoint site.

Tadah provides all services at the Swiss Re Kids House premises at Lavaterstrasse 93, 8022 Zurich as well as at playgrounds and other outing locations. Vacation courses may be an exception.

  1. Registration childcare contract and booking

2.1. Registration

The contract between the Customers and Tadah, begins with the registration at www.booking-kidshouse.ch, hereinafter referred to as "Booking System". This contract is concluded for an indefinite period.

2.2. Admission criteria

The Swiss Re Kids House is only available to children of Swiss Re employees.

Children can be cared for on flexibly selectable spots from half a day to five days a week during the defined opening hours. Half-day and full-day care is offered.

The operator reserves the right to refuse to accept children without giving reasons in the interest of the children's well-being. The caregivers are not specially trained to care for children with physical and/or mental or psychological disabilities. However, Swiss Re Kids House makes every effort to find a suitable solution for each child. 

If the child is cared for at Swiss Re Kids House, the Customer must work at a workplace at Swiss Re Campus Mythenquai. This can either be in his/her regular office or in the specially provided workspace on the 3rd floor of Lavater House. The Customer may only leave Swiss Re's premises at the Campus Mythenquai location in exceptional circumstances and for not longer than 5 hours - see more on this under point 5.2.

The order of registration is taken into account up to the maximum capacity of the Swiss Re Kids House (see section 2.5 below). The caregivers are not specially trained to care for children with special needs and therefore Tadah is not in a position to offer childcare for such children.

2.3. Admission and signing of the contract

Parents or legal guardians working at Swiss Re can contact the Swiss Re Kids House via the website URL on-demand to book a childcare place for their child/children, provided there are still sufficient childcare places available (see below, item 2.5). If the online booking system is out of order, bookings may be made by e-mail or telephone.

Bookings must be paid for prior to the booking start time (see below, item 4.5).

The type and scope of services are determined by the childcare contract (i.e. these GTCs, the services offered in the Booking System, the operating concept and the pedagogical concept).

The GTCs, valid at the time of each booking, are applicable. The operating concept and the pedagogical concept are an integral part of the contract and are automatically accepted by the Customer at the time of each booking. The documents can be accessed on the Booking System and Swiss Re Kids House SharePoint site.

Customers cannot transfer a purchased childcare slot to third parties.

2.4. Personal online account

The Customer creates a user account when he or she registers in the Swiss Re Kids House Booking System. The access code and personal password must not be passed on to third parties and must be protected against unauthorized access. The Customer is liable to Tadah for misuse in this context; in particular, bookings made on the basis of misuse of the access code and personal password are at the Customer's expense.

The Customer undertakes to provide the requested data about him/herself and his/her child/children completely and correctly in his/her online account and to store it in the Booking System. If there is a change in the data provided after registration, the Customer is obliged to notify Tadah of the change without delay or to change it in the online account

2.5. Availability and booking

The availability of childcare places at Swiss Re Kids House cannot be guaranteed by Tadah and will be offered on a first-come-first-served basis only.

The childcare places are never automatically released by the Booking System. Tadah controls every single booking and releases it when there are enough caregivers to ensure quality childcare. The entitlement to a childcare place only arises after approval by Tadah. Tadah reserves the right to cancel the childcare option at short notice, should one or more caregivers drop out at short notice or other unexpected and unforeseen events occur, over which Tadah has no influence, which prevent the operation of the Swiss Re Kids House. In such a case, no childcare fee is due.

Childcare places must be booked at least forty-eight (48) hours before the start of the respective childcare session. For bookings at shorter notice, please contact Tadah by e-mail or telephone. As soon as a written confirmation is received either via Booking System or e-mail, the place in the childcare is reserved and guaranteed (however, see previous section regarding reservation in case of cancellations or unforeseen events).

3.Opening hours

In general, Swiss Re Kids House is open year round Monday through Friday from 07:45 am to 6:15 pm.

Swiss Re Kids House will be closed on all public holidays in the Canton of Zurich as well as between the Christmas and New Year holiday period. The exact dates will be published on the Swiss Re Kids House SharePoint site at least 6 months in advance. See more details in the operational concept.

  1. Prices and payment arrangements

4.1. Childcare fees

The use of Tadah's services is subject to different types of tariffs. The use, scope and times determine the tariff type. In the event of a change in the VAT regulations, the prices will change accordingly.

The smallest booking and billing unit is a half-day (5.25 hours). At the end of the day, the respective unit is deducted from the Customer's credit according to the following rules:

• Stay of up to 5.25 hours (1-315 minutes): a half day (unless booking starts before 11.30 am and ends after 1 pm; in such case a full day will be charged • Stay of more than 5.25 hours (315-630 minutes): a full day

4.2. Costs for childcare outside regular opening hours

If the drop-off of the child takes place more than fifteen (15) minutes late, this must be reported to Tadah by telephone. Late pick-up of children after the booked hours will be charged CHF 40.- per half hour for the first half hour, and CHF 80.- for each additional half hour. Any additional (third-party) costs in this connection shall be borne entirely by the Customer. All costs will be charged to the credit card on file for Customer in the Booking System.

4.3. Subsidised childcare places

Tadah does not offer subsidised childcare rates financed by the city of Zurich.

4.4. Statements for the tax return

Tadah will issue statements for tax returns and send them to the Customers via e-mail in January for the previous year.

4.5. Payment arrangements

Childcare fees are due as soon as the booking is confirmed and can only be paid via the Customer's credit card on file in the Booking System. The fees will be charged automatically to the Customer’s credit card on file.

If the credit card cannot be charged or if no credit card is on file, Tadah will contact the Customer and ask him/her to update or file his/her credit card information in his/her account. Should Tadah not be able to reach the Customer and should the credit card not be able to be charged, the booking will be cancelled and the Customer will be informed.

  1. Childcare

5.1. Settling-in period

The Swiss Re Kids House has a flexible settling-in concept that is designed individually. From a pedagogical point of view, Tadah is concerned with carefully acclimatizing the children to the Swiss Re Kids House daily routine and settling them in well. In an initial meeting, the caregivers will agree with the Customer which type of settling-in should be used.

From an educational point of view, children visiting Swiss Re Kids House for the first time may not be booked in and cared for more than 5.25 hours.

The settling-in period is charged at the standard tariffs.

More details on the acclimatization process can be found in the corresponding concepts and are considered read and agreed upon to with the acceptance of these GTCs.

5.1. Regulation in case of absence of parents

If Customer has their child/children looked after at Swiss Re Kids House, they must work at Swiss Re Campus Mythenquai during the effective childcare hours.

In exceptional cases, they may leave Campus Mythenquai for brief external appointments. For this purpose, the regulation in case of absence of Customer (parent/guardian) from the operating concept and the pedagogical concept apply.

All external meetings must be announced by Customer in advance and the form "External Meeting" must be either filled in via the Booking System or signed and given to Tadah childcare staff. A clear time frame must be defined by Customer which must not exceed five hours. The Tadah childcare staff may call the Customer at any time and they are obligated to be on site at Swiss Re Kids House within 30 minutes. If this cannot be ensured, the Customer who dropped off the child at Swiss Re Kids House must name another person who may pick up the child. This person must show official identification (with picture) when picking up the child.

5.2. Childcare hours

The children are looked after exclusively during the regular opening hours of Swiss Re Kids House. The booked times are binding on Customer

At the expiry date of the booking, the child and Customer must have left the Swiss Re Kids House. If Customer would like a summary of the day, they must allow sufficient time for this and come in earlier to get the information wanted from the Tadah childcare staff.

There is a curfew between 11.30 am and 1 pm. To ensure the smooth running of the lunch period and midday rest, no children may be brought or picked up during this time.

Swiss Re Kids House management and Tadah childcare staff may ask Customers to pick up their child at any time if they deem it necessary - this is at the sole discretion of Swiss Re Kids House management (e.g. illness, accident, other incident). Customers are required to pick up their child within 30 minutes of being contacted.

5.3. Check in / Check out

The Customer will be checked in at the reception upon arrival at Swiss Re Kids House. The Booking System then records the Customer as logged in and counts the hours of the child's presence. At the end of the day, the Customer is checked out again.

Based on this data, any additional costs that do not correspond to the invoiced and already paid for product via the Booking Tool are further invoiced at the end of the day (e.g. parent exceeding the booked time slot of half a day).

5.4. Supervision

Tadah cares for and supervises children at Swiss Re Kids House in accordance with the childcare contract, beginning with the personal handover of the child to the Tadah childcare staff until the child is personally picked up by the Customer or another person authorised by the Customer.

If the Customers designates another person to pick up the child, this must be communicated in advance to the Tadah childcare staff. Tadah childcare staff must ask other designated persons for an ID card with picture before releasing the child to them.

Tadah childcare staff are allowed to arrange for transportation for a child if necessary. However, this will only occur in exceptional cases, e.g. for quick medical care after an accident or by arrangement with the Customer, and Tadah childcare staff will accompany the child in such a case.

During joint events with Customers, regardless of whether inside or outside the facility, the responsibility for the child lies exclusively with the Customer.

  1. Termination and cancellation arrangements

6.1. Refunds

If a booking is cancelled by the Customer or Tadah within the allowed time frame (at least one month in advance - same date of the previous month or earlier), the cancellation is free of charge. If a booking is cancelled by the Customer less than one month before the planned start of the booking, the booking will be fully charged and no refund will be granted.

6.2. Cancellation

The childcare contract can be terminated by the Customer at any time. Pending Bookings may only be refunded in accordance with clause 6.1.

If a child shows gross behavioural problems and cannot be integrated into the normal childcare routine (at the discretion of Tadah), Tadah reserves the right to terminate the contract without notice. This applies in particular in the case of violent behaviour of a child towards other children or if the Customer refuses a clarification of behavioural problems by appropriate specialised agencies. Any unused credit for subsequent days will be refunded to Customer.

Furthermore, Tadah reserves the right to terminate the contract without notice if the Customer provides false or incomplete information about himself/herself and/or the child during the registration process, during bookings and before or during the term of the contract.

6.3. Annulations

Short-term absences due to illness or other reasons must be announced no later than 8.15 am on the day in question. Booked childcare days (or half days) will be charged. An already booked place in the Swiss Re Kids House can be cancelled free of charge in accordance with the refund regulation in clause 6.1.

  1. Liability, insurance and accident/illness

7.1. Liability and insurance

Each party is liable to the other party for breach of contract pursuant to the statutory rules, in particular pursuant to art. 394 et ss. of the Code of Obligations regarding mandate agreements.

The liability of the breaching party to the other party is limited to CHF 15'000'000 per event and CHF 30'000'000 per year.

Customers shall ensure that children attending the Swiss Re Kids House shall have a third-party liability as well as a health and accident insurance.

7.2. Warranty

Tadah guarantees the execution of the services according to the childcare contract with highest care.

7.3. Accident / Illness

Sick children and especially children with contagious diseases are not allowed to visit the Swiss Re Kids House and will be rejected. There is no right to a refund except as in line with clause 6 above.

In particular, in case of contagious diseases or fever of 38C or more, the child may not be brought to Swiss Re Kids House even if the fever has been reduced with medication.

Children with a cold or temperature up to 37.9C are allowed to visit the Swiss Re Kids House if their condition allows it.

In the event of an accident, Tadah proceeds according to the safety concept.

Children with previously treated limitations (broken arm, broken leg, etc.) may be brought to the Swiss Re Kids House. It is up to the staff to decide to what extent the child can participate in the activities and any consequences (e.g. delay in the healing process) are at the Customer's risk.

If a child has to take medication, the instructions according to the safety concept must be observed and followed.

  1. Subcontracting

Tadah may not call in third parties for the fulfilment of the obligations in this Agreement which are directly related to childcare. However, Tadah may subcontract to third parties other obligations, such as the IT booking platform, etc.

  1. Privacy

Tadah observes the regulations of the Swiss Federal Law on Data Protection (DSG).

The Customer agrees to the privacy policy published on the Booking System and Swiss Re Kids House SharePoint site.

The Customer confirms that all information provided in the registration form of the Booking System is true and complete. The Customer is responsible for immediately notifying the Swiss Re Kids House management of any changes to personal data relevant to the childcare contract or for changing such data him/ herself in his/her booking account.

  1. Photos, livestreams, events, media presence and the press

The Customer consents to Tadah taking photographs and video recordings on the premises of Swiss Re Kids House and on playgrounds and field trips. Photographs or recordings of the children may be used or published in any media only with the explicit written approval of the Customer.

  1. Final provisions

11.1. Severability clause

Should individual clauses of this contract be or become invalid, or wholly or partially unenforceable, or should a loophole in this contract become apparent, the validity of the other clauses shall not be affected.

11.2. Applicable law and place of jurisdiction

The service contract between Tadah and the Customer is subject to Swiss law. The exclusive place of jurisdiction for all claims and/or disputes arising from or in connection with this contract is Zurich.

11.3. Queries and complaints

Queries and complaints can be communicated to Tadah via discussion with childcare staff at Swiss Re Kids House or via e-mail [email protected].
